Obviously I can't comment on legal position but would be well peeved to say the least !
Honda dealer back,in early 1990s had a brand new car returned because it was red under a street light you could see two of the panels were not the correct red colour match to the rest of the car. Turns out it had been damaged in shipping unknown to the dealer and repaired. Outcome New car ordered for the owner
Sounds like poor form to me. Bad publicity too. I'm sure it happens all the time though - a rejected car is unlikely to be crushed, and as long as it is fixed the new owner will likely never know.
